John N. (Nick) Fountain
Nick Fountains's thirty-five year practice has particular focus in areas of Administrative Law including prosecution and defense of Licensing Board matters before the N.C. Medical Board, N.C. Board of Dental Examiners, N.C. Psychology Board, N.C. Real Estate Commission, N.C. Board of CPA Examiners, North Carolina State Bar, N.C. Licensing Board for General Contractors, N.C. Board of Plumbing, Heating and Fire Sprinkler Contractors, N.C. Board of Examiners of Electrical Contractors and other licensing agencies. His administrative practice includes experience before the North Carolina Utilities Commission, State Revenue Department, Purchase and Contract matters and in Health Care matters including Certificate of Need proceedings.
Nick's varied practice has given him in-depth experience in a wide variety of business and litigation issues. In addition to Administrative Law, Nick has substantial involvement in litigation of business acquisition and shareholder disputes, real estate litigation including boundaries, condemnation, zoning, and restrictive covenants, estate administration and will caveats.
Nick is a certified Mediator and has resolved many types of disputes. His varied practice and contacts with numerous lawyers have given him wide recognition and use as a Mediator.
Nick is listed North Carolina Super Lawyers for 2007 and 2008 and Best
Lawyers in America. He heads one of the Business/Administrative Practice
Teams within the firm and serves on our Practice Management Committee and Board
of Directors. Nick came to Young Moore in 1990 after twenty years with another
firm in Raleigh. He began his practice with a Judicial Clerkship with Judge (later
Justice) David M. Britt with the North Carolina Court of Appeals

- Lecturer on Trials of Real Property Cases, on the North Carolina Administrative Code, and on Issues in Occupational Licensing
Reported Decisions:
- Nick has been involved in more than forty reported decisions in the North Carolina Supreme Court, Court of Appeals as well as the U.S. District Court and the Fourth Circuit. Decisions have involved matters including real estate reversionary rights, restrictive covenants, zoning and land use, taxation, civil rights, insurance ratemaking, product liability, personal injury.
