Young Moore and Henderson represents firms, professionals and quasi-independent boards in administrative and judicial proceedings related to the threatened loss, discipline or acquisition of licenses to engage in practice as health care professionals, including physicians, dentists, nurses, physical therapists, psychologists and others. The firm is also extensively involved in similar issues related to general contractors, sub-contractors, accountants, realtors and geologists. Such proceedings frequently precede or follow malpractice claims and similar litigation against the professional in question. The firm is also general counsel to state licensing boards, including the Plumbing, Heating and Fire Sprinkler Board and the Electrical Board. The extensive experience of the lawyers in the firm has led to a courteous and respected relationship with board members and staff at many of the boards headquartered in Raleigh, the capital city of North Carolina. Our direct participation in the creation of the administrative hearing structure applicable to the boards provides our clients an advantage in understanding and dealing with the detailed and complex procedures and substantive rules of the boards.
We have assisted individuals to resolve matters successfully involving the North Carolina Medical Board, N.C. Board of Dental Examiners, N.C. Board of Pharmacy, N.C. Board of Nursing, N.C. Psychology Board, N.C. Auctioneer Licensing Board, N.C. Commissioner of Banks, N.C. Real Estate Commission, N.C. Board of CPA Examiners, N.C. Alarm Systems Licensing Board, and N.C. Board of Hearing Aid Dealers and Fitters.
We urge the earliest possible involvement in such issues and the opportunity to communicate formally or informally with state agency staff during the investigative phase of any such proceeding, as early involvement can prevent the agency from becoming prejudiced against the client and because professionals need to remain well-informed when their livelihood is threatened. The firm is equally qualified and willing to carry such matters through the administrative hearing process leading to a final administrative decision, and to judicial review in the Superior Court or appellate courts.
