Professional Liability
Young Moore and Henderson has many years of experience in the litigation and trial of all types of alleged Professional Liability, in addition to the experience of its Medical Malpractice Defense and Nursing Home/Long Term Care Litigation practices (see Medical Malpractice Defense and Nursing Home/Long Term Care Litigation sections). The professional liability practice of the firm primarily derives from its Insurance Defense practice (see Insurance Defense section). The firm represents insured and self-insured clergy, attorneys, psychologists, psychiatrists, insurance agents and brokers, engineers, architects and contractors in litigation or in providing advice in avoidance of litigation. We are particularly appreciative of our reputation gained in representing attorneys in all areas of practice and throughout the state, since it is the attorney client who is in a unique position to understand and appreciate the professionalism and competence of the firm.
Our years of experience in professional liability defense have given us a unique appreciation for the personal and business impact that allegations of malpractice or malfeasance have on the professional. The firm gives special attention to and seeks constant input from the professional and the insurer in order to master the issues involved, objectively evaluate the risks of the litigation, and clearly identify reasonable goals and objectives for the litigation. We encourage the use of alternative dispute resolution, and employ those skills unique to ADR to seek favorable resolutions of disputes while avoiding the stresses, disruptions and risks attendant with trials.
The firm also provides professional liability insurance coverage advice, as well as trial and appellate litigation services to insurers on the full array of professional liability (see also section on Insurance Coverage Analysis).
The firm also represents professionals before the various government agencies and licensing or disciplinary boards. (See separate sections for Administrative Law and Licensing Boards).
